This Privacy Policy (the “Policy”) represents the policy of EquipCheck, LLC (“EquipCheck”) regarding the collection, use, and management of personal data belonging to clients of EquipCheck. This Policy explains how EquipCheck uses the personal data collected from its clients when clients employ our services.

This Policy applies to all users (collectively “Users” and each individually, a “User”) of the EquipCheck website located at getequipcheck.com and all other websites owned and operated by EquipCheck (“Sites”) and related mobile applications, features or other services anywhere in the world (collectively, the “Services”).

By accessing or using the Services, you signify that you have read, understand, and agree to be bound by this Policy. This Policy applies to all online communication with and/or on the Services. When you provide us with information through any of the Services, we respect your privacy. It is important for you to understand what information we collect about you during your visit and what we do with that information.

PERSONAL INFORMATION COLLECTED

We collect information from you in various ways when you use our Sites and Services. We may collect personal information you directly provide on our Sites. In addition, we may collect personal information from you as a User of our Services. Information we may collect includes:

Personal identifying information, including name, postal address, email address, phone number, date of birth, and proof of identity;
Social media handles or information that you make available to us or to the public;
Financial information such as credit card, bank account, or other payment details;
Information gathered from the examination of public and private blockchains, including blockchain identifiers such as blockchain addresses and public keys;

Among other things, the use of cookies helps us to improve our Sites and your experience. We use cookies to see which areas and features are most popular, to count the number of computers accessing our Sites, to personalize your experience, and to remember your preferences. We link the information we store in cookies to any personally identifiable information you submit while on our site. The use of cookies by our service providers is not covered by our privacy statement. We do not have access or control over these cookies. Our service providers use session ID cookies to collect data in order to enable us to provide a better User experience.

WEB BEACONS

We and our third party partners use Web beacons that help us better manage content on our site by informing us what content is effective. Web beacons, also known as gifs, are electronic images that may be used on our Sites or in our emails. A Web beacon may be used on our Web pages to collect information, deliver cookies, count visits, understand usage and campaign effectiveness, or in our emails to tell if an email has been opened and acted upon.

USE OF PERSONAL INFORMATION WE COLLECT

We use your personal information to provide you with services, to operate and improve our Sites and Services, to send you messages, and for other purposes described in this Policy or disclosed to you on our Sites or in connection with our services. We use the information we collect from you on our Sites and Services:

to conduct an aggregated analysis of the performance of the Services.

EquipCheck may store and process personal information in the United States and other countries.

The Services EquipCheck provides for its clients include inventory management and tracking, and EquipCheck collects data from its clients in order to perform such Services.

Clients consent to the release of this information and data to EquipCheck for the purpose of the performance of EquipCheck’s services for the client’s benefit. This release of information and the relationship between EquipCheck and its clients is subject to the general Terms and Conditions, and the Master Services Agreement, which are provided to clients when EquipCheck’s services are retained.

SHARING OF PERSONAL INFORMATION

We may use third parties such as email Service Providers to send out emails on our behalf or merchant service providers for payment processing. When you sign up for our Services, we will share the personal information you provide only as necessary for the third party to provide that service.

We do not share your personal information with third parties other than as described above and as follows:

With third party vendors, consultants and other service providers (“Service Providers”) who are working on our behalf and need access to your information to carry out their work for us;
To (a) comply with laws or respond to lawful requests and legal process, (b) to protect the rights and property of EquipCheck, our agents, members, and others including to enforce our agreements, policies and terms of use, or (c) in the good faith belief that disclosure is needed to respond to an emergency or protect the personal safety of any person; and
In connection with any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. In any such event, we will provide notice if your data is transferred and becomes subject to a different privacy policy.

SECURITY OF YOUR PERSONAL INFORMATION

The security of your personal information is important to us. When you enter sensitive information (such as credit card number) on our registration or order forms, we encrypt that information using secure socket layer technology (SSL).

EquipCheck takes reasonable security measures to protect your personal information to prevent loss, misuse, unauthorized access, disclosure, alteration, and destruction. Please be aware, however, that despite our efforts, no security measures are impenetrable.

If you use a password on our Site, you are responsible for keeping it confidential. Do not share it with any other person. If you believe your password has been misused, please advise us immediately.

CHOICES ABOUT USE OF YOUR INFORMATION

You may “opt-out” of receiving promotional emails from EquipCheck by following the instructions in those emails. You may also send requests relating to promotional messages and your permission for sharing information with third parties for their marketing purposes by emailing contact@getequipcheck.com. Opt-out requests will not apply to transactional service messages, including messages about your current account with EquipCheck and services.

UPDATING AND ACCESSING YOUR PERSONAL INFORMATION

If your personal information changes, we invite you to correct or update your information as soon as possible. You can request changes or access to your information by emailing contact@getequipcheck.com.

HOW LONG WE RETAIN YOUR PERSONAL INFORMATION

We will retain your information for as long as your account is active or as needed to provide you Services. If you wish to cancel your account, request that we no longer use your information to provide you services or delete your personal information, contact us at contact@getequipcheck.com. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

LINKS TO OTHER SITES

Our Site includes links to other websites whose privacy practices may differ from those of EquipCheck. If you submit personal information to any of those sites, your information is governed by their privacy statements. We encourage you to carefully read the privacy statement of any website you visit.

TESTIMONIALS

We may post customer testimonials on our website which may contain personally identifiable information. We obtain the customer’s consent prior to posting the testimonial to post their name along with their testimonial.

CHILDREN’S PRIVACY

EquipCheck’s Sites are not targeted to children under the age of 13 and we do not intentionally collect personal information from children under the age of 13. If we discover that a child under the age of 13 has provided us with personal information through this website, we will take reasonable steps to delete the information. If you believe we may have accidentally received personal information from a child under the age of 13, please contact us immediately.

EQUIPCHECK MAKES NO WARRANTY, EITHER EXPRESS OR IMPLIED, REGARDING THE SUFFICIENCY OF THIS POLICY IN PREVENTING THE IMPROPER OR UNWANTED DISCLOSURE OF INFORMATION. EQUIPCHECK SHALL NOT BE RESPONSIBLE FOR ANY ACTUAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM A BREACH OF THIS POLICY, ANY UNAUTHORIZED BREACH OF EQUIPCHECK’S SERVERS BY AN UNAUTHORIZED PARTY, OR FROM ANY SOFTWARE ERROR OR MALFUNCTION. TO ASSIST EQUIPCHECK IN PROTECTING YOUR INFORMATION, IT IS CRITICAL THAT YOU DO NOT SHARE YOUR LOGIN OR PASSWORD WITH ANY OTHER INDIVIDUAL OR ENTITY.

YOUR CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83 permits customers of EquipCheck who are California residents to request and obtain from us once a year, free of charge, information about the personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of personal information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding twelve (12) calendar months. If you are a California resident and would like to make such a request, please submit your request in writing to contact@getequipcheck.com.

UPDATES TO THIS POLICY

We may occasionally update this Policy. If we make significant changes, we will notify you of the changes through the EquipCheck Sites or through others means, such as email. To the extent permitted under applicable law, by using our services after such notice, you consent to our updates to this Policy. You are responsible for regularly reviewing this Policy.
